Protection of Employees’ Personal Information under Workplace Surveillance

چکیده

By analyzing the civil litigation cases involving workplace video surveillance in China, it is founded that courts have taken a more lenient altitude to action of surveillance, and paid less attention personal information rights employees may be damaged by this action, resulting low efficacy relief. In addition, based on management rights, “implied consent” rules excessive employers violate handling. The special protection employees’ can help maintain dignity employees, enhance interests employer, re-correct unfavorable positions labor relationships. To solve these issues improve information, paper proposes two suggestions critical reference experience judgments overseas similar cases. Specifically, clarify principle handling an processing rule proposed, which takes proportionality as core. Additionally, public interest should considered way remedy thereby effectiveness information.
